Planning These houses are second homes, and the relevant planning consent (P/01047/07 – TCP/26385 14 March 2006) states that none of the dwellings (t)hereby approved shall be used other than as holiday accommodation. There is no restriction in the relevant documentation as to the number of weeks per year that the properties may be occupied. Services All properties will be connected to mains gas, water (metered), electricity, telephone and foul drainage (via a shared, pumped system), subject to the conditions and stipulations of the relevant utility companies. Tenure A freehold interest in each of the 48 new houses will be sold with the benefit of a 10 year NHBC Buildmark guarantee. It is proposed that the freehold interest in the common parts of the residential estate will be transferred to Island Harbour Residents' Association Limited of which each of the freehold owners of the 48 new houses will be required to become members of on completion. Each buyer will have the right to use a single designated parking space in the car parking areas allocated, with further visitors' spaces available. A right to use a 10 metre mooring berth that can accommodate a monohull vessel up to 12 metres in length (15 metre moorings for 17 metre vessels for the penthouses) will also be granted. Berths will be allocated by a volunteer berthing master appointed by the Residents' Association. Moorings for vessels exceeding these lengths may be available in the commercial section of the marina upon payment of additional berthing fees. Annual service charge A service charge at a commencing rate of £1,000 per year will be payable by each buyer to the Residents' Association to cover the annual cost of maintenance and repair of the common parts and facilities. The service charge will be subject to review at 5 yearly intervals and increased to a maximum of RPI in the period under review plus 1%. Reservation and reservation deposit To reserve a property in the development, payment of a non-refundable reservation deposit of GBP £2,000 (£5,000 for penthouses) and completion of the Seller's standard Reservation Deposit Form is required. Copies of the forms can be obtained from the Joint Sole Agents. Cheques should be made payable to the Seller's solicitors, Vizards Tweedie LLP, who will hold the deposit funds pending completion of the sale. The balance of a 5% deposit will be payable to the Seller's solicitors on completion of the concrete floor slab of the dwelling, with the remaining 5% of the deposit payable on completion of the construction of the dwelling to first floor level. Payment of the balance of the purchase price will be due within 5 working days of the completion of the construction of the dwelling.
